NOTICE OF MEETING AND SUMMARY OF PROPOSED ORDINANCE

 

Notice is hereby given that the Borough Council of the Borough of New Stanton Westmoreland County Pennsylvania is considering enacting an Ordinance vacating portions of three alleys within the Town of New Stanton Plan also known as the Village of New Stanton Plan pursuant to Sections 1731 and 1732 of the Pennsylvania Borough Code. The following is the proposed language of the amended Ordinance:

 

AN ORDINANCE VACATING CERTAIN PORTIONS OF ALLEYS KNOWN AS APPLE TREE ALLEY (TWENTY FEET IN WIDTH) BACK ALLEY (TWENTY FEET IN WIDTH) AND DIAMOND ALLEY (FIFTY FEET IN WIDTH) ALL IN THE PLAN OF LOTS KNOWN AS THE TOWN OF NEW STANTON PLAN ALSO KNOWN AS THE VILLAGE OF NEW STANTON PLAN WITHIN THE BOROUGH OF NEW STANTON SAID PLAN BEING RECORDED IN THE RECORDER OF DEEDS OFFICE IN DEED BOOK 29 PAGE 570.

 

SECTION 1: The following portions of property being portions of alleys are hereby vacated: Apple Tree Alley twenty feet in width from the southern line of Arona Road to the northern line of Back Alley; Back Alley twenty feet in width from the eastern line of Center Avenue to the western line of Wentsler Avenue; and Diamond Alley fifty feet in width from the southern line of Arona Road to the northern line of Back Alley. All of these portions of property are within the plan of lots known as the Town of New Stanton Plan also known as the Village of New Stanton Plan within the Borough of New Stanton said Plan being recorded in the Recorder of Deeds Office in Deed Book 29 Page 570 as set forth in the documents attached as Exhibit A.

 

SECTION 2: This Ordinance is adopted pursuant to the authority granted to the Borough of New Stanton by Sections 1731 and 1732 of the Pennsylvania Borough Code as amended and is enacted following petition and public hearing and with agreement of a majority of the property owners abutting and affected by the vacations.

 

SECTION 3: The vacations hereby made are to the extent and only to the extent of extinguishing the Borough’s rights in the aforesaid portions of alleys for the passage or purposes of public travel.

 

SECTION 4: If any sentence clause section or part of this ordinance is for any reason found to be unconstitutional illegal or invalid such unconstitutionality illegality or invalidity shall not affect or impair any of the remaining provisions sentences clauses sections or parts of this ordinance. It is the intent of the Borough Council that the remaining provisions of this Ordinance would have been enacted had such unconstitutional illegal or invalid sentence clause section or part not been included herein.

 

Notice is also directed to the following owners of property abutting on or adjacent to the portions of the alleys that the Borough Council is considering vacating by the proposed Ordinance:

The Borough Council intends to take action on the proposed Ordinance at its regularly scheduled meeting to be held on October 7 2025 immediately following a 6:00 P.M. public hearing on that date on Dennis F. Rosenberry’s petition to vacate the above-stated portions of alleys. Copies of the proposed Ordinance may be viewed at the Borough Office at 318 Paintersville Road New Stanton PA 15672 between the hours of 9:00 A.M. and 4:00 P.M. Monday through Friday until 4:00 P.M. on October 7 2025.
