NOTICE OF INTENT TO ADOPT ORDINANCE

 

The Board of Supervisors of Fawn Township Allegheny County Pennsylvania will consider for adoption the following ordinance at a public meeting to be held on March 10 2026 at 6:00 P.M. at the Fawn Township Municipal Building 3054 Howes Run Road Tarentum PA 15084 or at such other time and place as may be advertised. The Ordinance is entitled “AN ORDINANCE GOVERNING MUNICIPAL MANAGEMENT OF ONLOT SUBSURFACE SEWAGE DISPOSAL FACILITIES.”

 

The Ordinance establishes a Sewage Management Program for Fawn Township pursuant to the Pennsylvania Sewage Facilities Act (Act 537) and the Clean Streams Law. The Ordinance includes but is not limited to the following provisions:

 

Section I – Short Title; Purpose. Establishes the Ordinance title and states the purpose of protecting public health and the environment through regulation of onlot sewage disposal systems.

 

Section II – Definitions. Defines terms necessary for interpretation and enforcement of the ordinance including onlot sewage disposal systems sewage management programs sewage enforcement officer malfunction and small flow treatment facilities.

 

Section III – Applicability. Provides that the Ordinance applies to properties served by onlot sewage disposal systems within designated sewage management districts identified in the Township’s Official Sewage Facilities Plan.

 

Section IV – Permit Requirements. Requires permits for installation alteration repair or replacement of onlot sewage disposal systems and establishes coordination with the Township Sewage Enforcement Officer.

 

Section V – Inspection. Authorizes inspections of onlot sewage disposal systems establishes initial and routine inspection requirements and provides procedures for addressing malfunctioning systems.

 

Section VI – Operation. Restricts discharges into onlot sewage disposal systems to normal domestic waste and prohibits industrial hazardous and other improper discharges.

 

Section VII – Maintenance. Establishes mandatory pumping maintenance reporting and record‑keeping requirements for septic tanks and aerobic treatment systems.

 

Section VIII – System Rehabilitation. Provides procedures and timelines for repair replacement or mitigation of malfunctioning onlot sewage disposal systems.

 

Section IX – Liens. Authorizes the Township to perform necessary corrective work and impose municipal liens where property owners fail to comply.

 

Section X – Disposal of Septage. Requires proper disposal of septage in accordance with state law and Department of Environmental Protection regulations.

 

Section XI – Small Flow Treatment Facilities. Establishes requirements for ownership operation maintenance agreements indemnification and connection to public sewer where available.

 

Section XII – Administration. Authorizes Township administration staffing record‑keeping and fee schedules necessary to implement the Sewage Management Program.

 

Section XIII – Appeals. Provides procedures for appeals to the Board of Supervisors from Township determinations under the Ordinance.

 

Section XIV – Penalties. Establishes fines and penalties for violations including daily offenses.

 

Section XV – Repealer. Repeals inconsistent Ordinances or parts thereof.

 

Section XVI – Severability. Provides that invalid provisions shall not affect the remainder of the Ordinance.
