NOTICE OF INTENT TO ADOPT ORDINANCE

 

The Board of Supervisors of Fawn Township Allegheny County Pennsylvania will consider for adoption the following ordinance at a public meeting to be held on March 10 2026 at 6:00 P.M. at the Fawn Township Municipal Building 3054 Howes Run Road Tarentum PA 15084 or at such other time and place as may be advertised. The Ordinance is entitled “AN ORDINANCE REGULATING AND CONTROLLING THE OPERATION AND USE OF RECREATIONAL VEHICLES.”

 

A summary of the Ordinance is as follows:

 

Section 1 – Recitals. Incorporates the background recitals as part of the Ordinance.

 

Section 2 – Purpose and Findings. States the purpose is to regulate recreational vehicles for the health safety and welfare of residents and lists findings such as accidents property damage noise and public nuisance. Cites authority under the Second Class Township Code.

 

Section 3 – Definitions. Defines key terms including “highway or street” “operate” “operator” “person” “recreational vehicle” “right-of-way” and “roadway.”

 

Section 4 – Regulations. Prohibits operation of recreational vehicles in certain locations and under certain conditions (e.g. on public highways private property without consent public lands at unreasonable speeds under the influence at night without lights near dwellings at night on cemeteries etc.). Provides special allowances for emergencies and permitted events.

 

Section 5 – Enforcement. Authorizes police peace officers or Ordinance enforcement officers to issue non-traffic citations for violations.

 

Section 6 – Penalties. Violations are summary offenses subject to fines up to $600.00 per day. Provides for imprisonment for nonpayment civil proceedings for damages/injunctive relief and allows both criminal and civil actions. The burden of proof for permission to ride on property is on the defendant.

 

Section 7 – Repealer. Repeals any inconsistent Ordinances or parts thereof.

 

Section 8 – Severability. Provides that invalid provisions shall not affect the remainder of the Ordinance.

 

Copies of the text of the proposed Ordinance are available at the Fawn Township Building the Allegheny County Law Library and this newspaper and may be examined without charge or obtained for a charge not greater than the cost thereof.
