California District Mining office has received a request for a public hearing regarding the draft effluent limits for the proposed application to issue the Rustic Ridge II National Pollutant Discharge Elimination System (NPDES) permit submitted on March 20 2025 by LCT Energy LP 938 Mt. Airy Drive Suite 200 Johnstown PA 15904.
The Department will hold a Public Hearing at St. Raymond of the Mountains Parish 170 School House Lane Donegal PA 15628 on Tuesday June 16 2026 beginning at 6:00 p.m.
The public hearing is being held at the request of multiple citizens and Mountain Watershed Association to take testimony from citizens on the draft NPDES permit for the proposed Rustic Ridge II mine. The requests indicated concerns about the quality of the water proposed to be discharged impacts on local drinking water and local ecosystems.
Members of the public will have the opportunity to present up to three minutes of oral testimony relevant to the draft permit. Those wishing to register for the public hearing must contact Laina Aquiline by email at laquiline@pa.gov or by calling 412-442-4311 at least 24 hours before the hearing. DEP requests that organizations designate one spokesperson to present testimony on their behalf. Individuals providing testimony are requested to submit a written copy of their verbal testimony by e-mail to Lori Jenkins lorjenkins@pa.gov after providing testimony at the hearing. Written comments will be accepted until close of business on June 30 2026.
The draft of the NPDES permit includes effluent limitations for Outfalls 001 002 and 003 associated with the operation of Rustic Ridge II.

Outfall 002 - Lat: 40° 08 52” Long: -79° 24 32" – Trib 37998 to Jacobs Creek
Outfall 003 - Lat: 40° 08 45” Long: -79° 24 40" – Trib 37997 to Jacobs Creek
The draft effluent limitations for the NPDES permit were published in the PA Bulletin on February 7 2026 (Vol. 56 No. 6). The proposed permit has not been issued and is pending.
